How to register a religious organization?

Religious organizations in Ukraine operate in several forms and are created to serve the interests of groups of people of a particular faith, as well as to provide religious education. Documents for registering a religious organization

The creation of a religious organization is possible in the following forms:

  • religious group (community);
  • administration, center;
  • monastery;
  • mission;
  • religious educational institution;
  • religious brotherhood.

In addition, the organizations listed above may combine their activities and create associations.

First of all, a religious organization needs to approve its charter at a general meeting (conference).

For the purpose of registering a legal entity, a common set of documents is required for all:

  • registration card;
  • decision to create a legal entity;
  • two copies of the charter.

Procedure for registering a religious organization

State registration of a religious organization actually takes place in two stages. The first is the registration of the organization’s charter. At this stage there are some differences.

To register the charter of a religious community, it must be created by at least 10 adult citizens. After that, the charter (signed by all the founders) and the application are submitted to the appropriate state administration (regional, for the cities of Kyiv and Sevastopol – city).

 


It is worth noting that the creation of a religious community does not require mandatory notification of state authorities. That is, a religious community can operate without carrying out any bureaucratic procedures. However, the creation of a legal entity provides the organization with many new opportunities.

All other forms of religious organizations (except for a religious community) submit their charter for approval to the state body that implements policy in the sphere of religion.

A period of 1 month is set for the consideration of the submitted documents, after which the applicant must be notified of the results within 10 days.

 


The period for consideration of documents may be extended to 3 months. An expert opinion on the provisions of the charter and a conclusion from local state authorities will be required. For this reason, the content of the charter should be treated with maximum responsibility so that no unnecessary questions arise during the registration process.

The second stage in the state registration process is the creation of a legal entity. For this purpose, the documents listed above are submitted to the state registrar at the location of the organization.
