Inheritance is the process of transferring the set of rights and obligations belonging to the deceased to other persons. Upon inheritance, all rights and obligations are transferred except those that are indivisible from the deceased’s person and terminate with his death. An heir does not have the right to accept only part of the rights and obligations being transferred. For example, one cannot accept ownership of a summer house and a car while refusing the deceased’s loan obligations. Even those rights and obligations of which the heir was unaware pass to the heir.
According to Ukrainian law, heirs are divided into five groups in the order of succession, which is determined by degree of kinship:
- the deceased’s children (even those born after his death), spouse and parents;
- siblings, as well as grandparents on both sides;
- uncles or aunts;
- people who lived with the deceased in the same family for 5 years prior to the opening of the inheritance;
- all relatives up to the sixth degree, and the deceased’s dependents.
Inheritance registration takes a long time. The inheritance opens on the day of death at the deceased’s place of residence. If the deceased’s place of residence is unknown, the inheritance is opened at the location of the real estate, and if there is none, at the location of the main mass of movable property. Confirmation of death can be a death certificate or a court decision declaring the person deceased. Heirs must come forward within six months after the opening of the inheritance. During this time the notary establishes the circle of heirs.
To accept an inheritance, the following documents must be submitted to the notary’s office:
- passport and identification code;
- a document confirming the death;
- if inheritance occurs by law, documents proving the degree of kinship with the deceased;
- documents proving the place of the deceased’s last residence.
To accept inheritance of property subject to registration, it is necessary to present title documents for it to the notary’s office.
After the full circle of heirs has been determined, six months after the date of death the heirs are issued certificates of the right to inherit. It should be remembered that ownership rights to property subject to state registration arise only after such registration by the new owners. It is the direct obligation of the heir to register real estate or a vehicle.
