How to create an OSBB (OSMD) in Ukraine?

To ensure effective management, use and maintenance of property, it is possible to create an association of co-owners of a multi-apartment building (OSMD) or, as it is called in Europe, a condominium.

Registering a condominium requires preparing a rather large package of documents and complying with strict procedures and deadlines.

A condominium is a legal entity, so organizing an OSBB must comply with the legislation on the registration of legal entities, but taking into account certain specifics.


Only one OSMD can operate within a single residential complex.

Most of the standard document forms for creating an OSMD are established by legislation. Therefore, you should treat this task responsibly, since the required documents are not drawn up in an arbitrary form; they must comply with clearly established requirements and standards. The list of documentation for creating a condominium depends on the specific stage of the registration process. We will consider them below.

Procedure for registering an OSMD

To create an association of co-owners, the following actions should be taken:

  1. Convene the founding meeting. The authority to do this lies with the owner of the building itself or an initiative group of at least 3 owners of premises (apartments or non-residential premises). Send each owner a notice of the meeting by hand against signature or by mail (written form is mandatory) no later than 14 days before the scheduled date. Prepare a draft charter.

2. Hold the general founding meeting. Important! For it to be competent, the presence of more than 50% of owners (i.e., 50% + 1) is mandatory. Issues to be considered: the establishment of the condominium and approval of the charter. For a decision to be successfully adopted, the consent of at least ⅔ of the attending owners is required, each of whom has one vote (regardless of the number of premises they own).

3. Register the legal entity. To do this you must submit the following package of documents to the local state administration:

  • registration card;
  • protocol;
  • charter (original – 2 copies, copies – 5 copies);
  • list of condominium members.

4. Include the OSMD in the Register of Non-Profit Institutions and Organizations. To do this, a registration application (form 1-RN) and copies of the founding documents are submitted to the local tax authority (DFS).

5. Open a bank account.


Tenants cannot be members of the OSMD; this right belongs only to owners of premises.
