Uniting for Ukraine: how to get into the refugee program for Ukrainians in the USA?

On February 24, 2022 the whole world recoiled at the terrible news: in the 21st century, in the very heart of Europe, a war began. Russia initiated an escalation of the armed conflict in Ukraine. Thousands of residents were harmed by incoming shells, left with nothing. World leaders did not remain indifferent; each has already provided support in the fight against the full-scale aggressor.

“Uniting for Ukraine (Uniting for Ukraine)” – this is how the President of the United States of America Joseph Biden announced the new program for refugees. The goal of the program is crystal clear: to provide assistance to the citizens of Ukraine.

The essence of the program is to enable our compatriots to obtain permission to cross the border in the shortest possible time with simplified requirements.

How to obtain the right to stay in the USA?

  1. As of 24.02.2022 you were present in the United States.
  2. Have a source of income or a sponsor in the USA,
  3. Have a certificate of having completed the full vaccination course,
  4. Pass a background check (you will not be allowed through without a background review).
  5. Submit biometrics

If everything goes well and the necessary documents are collected, a Ukrainian receives a humanitarian parole for a period of 2 years with permission to work (work authorization) in the United States.

Who can participate in the Uniting for Ukraine program?

It is suitable for you if:

  • Lived in the territory of Ukraine before the start of the Russian invasion and were forced to leave their place of residence as a result of hostilities
  • Have a valid Ukrainian passport;
  • Family members of a Ukrainian citizen (first-line relatives: spouses, children, and blood relatives);
  • Have completed the full course of vaccination against COVID-19;
  • Have completed biometric data submission;
  • Have a sponsor who can submit to the Immigration and Citizenship Service the corresponding Declaration of Financial Support;

Beneficiaries (Ukrainian citizens) do not have the right to apply independently. Since April 2022 Americans (individuals and legal entities) can submit a sponsorship application to the Department of Homeland Security. Sponsors can be U.S. citizens or individuals who have lawful status in the USA; in the application the sponsor is required to provide contact information for the people they are sponsoring.

Any non-governmental organizations may participate. After passing the review they will be issued permission to participate in the program.

Upon approval of the sponsor’s application to fund the Ukrainian’s stay, the latter will receive a notification by email with detailed instructions regarding the next steps to obtain humanitarian parole.

* Persons under 18 years of age have the right to enter only under the guardianship of a legal guardian.

Submitting documents

Procedure for submitting documents for “Uniting for Ukraine”

Stage 1: Sponsorship.

As mentioned above, participation in the program is only possible with financial support in the form of a sponsor. The process must be initiated by submitting electronic form I-134 (Declaration of Financial Support) to the Department of Homeland Security via the USCIS.gov website.

In order to prevent crimes against the beneficiary, U.S. law enforcement conducts a thorough review of the applicant to prevent unlawful coercion to work. Federal agencies must also ensure the ability to finance the sponsored person.

Stage 2: Verification of personal data and related information.

If the sponsor’s verification is successful, the American side sends the Ukrainian beneficiary an approval notification by email and instructions for further actions. The user registers on the USCIS.gov portal, provides the necessary biographical data according to all requirements.

Stage 3: Full vaccination course.

When verifying the account on the myUSCIS portal, persons planning to obtain entry authorization under the program are required to provide proof of vaccination against measles, coronavirus, and polio. If vaccines are absent, it is necessary to receive the first doses to enter the country. If there are medical contraindications — provide the corresponding documents that can confirm this fact.

Starting at age 2, all persons wishing to participate in the program must undergo a medical examination that rules out the presence of diseases such as tuberculosis. Undergo an IGRA (interferon-gamma release assay) test within 14 days of arrival in the U.S.

Stage 4: Obtaining humanitarian parole.

If all requirements are met, the applicant receives on their myUSCIS account confirmation of the right to enter the U.S., which will be valid for 3 months.

Air travel remains the responsibility of the Ukrainian side (you must arrange this at your own expense). You should also take into account the travel requirements of the Centers for Disease Control (CDC), so make sure to have a timely PCR test before departure.

Stage 5: Entry approval when crossing the border.

As a standard, every person wishing to obtain humanitarian parole is required to undergo inspection by U.S. Customs and Border Protection.

If you plan to cross the U.S. border via Canada or Mexico, remember: without a valid visa or authorization under the program for Ukrainian refugees, you will be denied entry. You must submit a preliminary application.

Stage 6: Entry permission.

Upon approval of humanitarian parole, Ukrainians are granted entry permission for up to 2 years. In addition, they have the right to apply for employment authorization in the United States. If you are an individual — you need to fill out form I-765 in your USCIS account.
