As a general rule, ownership of real estate arises after state registration. Since January 1, 2013, Ukrainian legislation has changed the procedure for registering ownership rights to real estate objects, simplifying it. Under the old scheme the BTI performed state registration after the notarization of the transaction, but now the notary also carries out the state registration and formalization of ownership rights to real estate. This reduces the transaction processing time to one day if all necessary documents are available. In the territorial state registration services the registration of rights for real estate objects that arose as a result of privatization or notarial actions performed before 2013 is registered.

The list of documents required for this procedure has also changed. For example: when executing a purchase and sale agreement for an apartment, it is no longer necessary to obtain a new technical passport.

Registration of ownership rights is now carried out in the new State Register of Rights to Real Estate instead of the Register of Ownership Rights to Real Estate.

The legislative changes were intended to simplify and significantly shorten the procedure for registering ownership rights, make the mechanism more efficient, and protect the interests of the parties and third parties in transactions for the disposal of real estate. In practice, however, many conflicts and ambiguities in the interpretation of the laws have arisen.
