Documents for enterprise registration with OVIR
According to Ukrainian legislation, to invite foreign citizens or stateless persons to work, as well as to receive business partners from abroad, registration of enterprises with OVIR (a migration service body) is required. This requirement applies to both domestic institutions and organizations, and foreign or joint ones. The Cabinet of Ministers of Ukraine (CMU) by its Resolution No. 567 dated 01.06.2011 approved the Rules, according to which a legal entity, as the receiving party, needs registration with OVIR already at the stage of issuing an invitation to a foreign employee.
This procedure is often called registration or accreditation with OVIR.
At the legislative level there is no fixed list of documents required for such a procedure. Therefore it makes sense for representatives of a legal entity to consult experienced specialists who in practice engage in such activities as accreditation of an enterprise with Kyiv OVIR.
In order to save time, the registration of the enterprise with OVIR can be combined with the procedure of issuing an invitation for a foreigner.
Documents for registration of enterprises with OVIR
Necessary documents for registration of enterprises with OVIR are submitted by the head of the legal entity or a responsible person. The list of documents:
- application on company letterhead;
- order appointing the head of the enterprise or order appointing a responsible person;
- passport of the head or responsible person (will be returned after submission of the documents);
- three photos of the head or responsible person sized 3.5 cm by 4 cm;
- the enterprise charter and certificate of registration;
- certificate from the statistics office;
- bank certificate confirming that the enterprise has a current account;
- guarantee letter stating the obligation of the legal entity, if necessary, to assume the costs of the foreigner’s maintenance and his departure from the country;
- document confirming ownership or use of the office premises;
- copy of the invited person’s passport with an attached translation into Ukrainian.
After reviewing the application for enterprise registration and the attached set of documents, the migration service official issues a registration card in two copies. One copy is handed to the person submitting the application. The second copy remains at the migration service where the enterprise’s registration file is opened. Immediately upon completion of registration with OVIR an invitation can be issued to a foreign citizen or stateless person, a visa and a work permit can be obtained.
