Restoration of Rights to the Child

Termination of parental rights is permanent, but if the parent’s personal circumstances have changed, they have the right to file a lawsuit requesting restoration of their rights to the child. The procedure for restoring parental rights is governed by Article 169 of the Family Code.

Grounds for restoring parental rights:

  • change in the parent’s behavior – if the mother or father has changed their lifestyle for the better;
  • elimination of the circumstances that were the basis for deprivation of parental rights – in case of recovery from alcohol or drug addiction, improvement of living conditions, employment;
  • defending the child’s interests.

A court decision in favor of restoring parental rights is sent to the civil registry office (ZAGS) to make the corresponding entry regarding the change in the child’s birth records. The parent again fully acquires the rights and responsibilities for raising and supporting the child.

How to restore parental rights?

If the father or mother wishes to resume their rights, they should contact the Juvenile Affairs Service and obtain a conclusion on the advisability of reinstating parental rights. After checking housing and living conditions and financial status, the commission will agree on the applicant’s ability to raise the child.

The court procedure begins after filing the lawsuit. The applicant must provide the following documents along with the claim:

  • identity document;
  • a copy of the child’s birth certificate;
  • certificate of place of registration and family composition;
  • workplace reference;
  • certificate of no criminal record;
  • conclusion from guardianship authorities;
  • receipt of payment of the court fee.

The court examines the reasons for restoring the plaintiff’s parental rights. The applicant must prove that they have corrected their behavior, improved their health, and that the reasons that led to the deprivation of parental rights will not recur. After analyzing the arguments and evidence, the judge issues a decision to grant or deny the restoration of parental rights.

After a refusal, it is permitted to file a repeat lawsuit to restore parental rights after one year.

When is it impossible to restore rights to a child?

You cannot restore rights to a child who has been adopted. An exception is if the adoption has been annulled or declared invalid by a court. It is impossible to restore parental rights with respect to an adult.

When issuing a verdict on restoring parental rights, the court takes into account the opinion of the other parent or lawful guardians with whom the children live.
