Closure of a religious organization

The law clearly defines “a religious organization is a legal entity”, therefore its establishment and termination must provide for state registration.

Religious organizations (RO) include communities, administrations and centers, monasteries, religious brotherhoods, missionary societies (missions), religious educational institutions or their associations. They all help citizens to profess and spread their faith, to understand the world and to interact in the hope of a bright future for themselves and their loved ones. However, in Ukraine over the past year the number of religious organizations has significantly decreased: as of January 1, 2014 there were 36,032 of them, while on January 1, 2015 there were 34,160. In one year 1,872 religious organizations ceased to exist. First of all, this is due to the economic and military instability in the country, which forces organizations to first use all internal and external resources for their existence, and after these are exhausted it becomes clear that the closure of the religious organization is inevitable.

It is worth noting that a religious organization may cease its activities through:

• reorganization – ceases its activities and transfers all its rights and obligations to another legal entity;
• liquidation – ceases not only its activities but also its existence, since the procedure does not provide for successors;
• court decision – in case of non-compliance with the legal requirements for the organization’s activities.

For example, grounds for the liquidation of religious organizations may be persistent disruption of order during worship services or rituals.

Liquidation of a religious organization is the most common form of termination of existence.

The legislation provides the following liquidation procedure:

• holding a general meeting;
• notification of the registration authority about the termination of the legal entity;
• performance by the liquidation commission of the duties assigned to it for liquidation;
• preparation of documents and their submission to the authorized body for termination of the legal entity’s existence.
