Employers’ organizations are created to coordinate actions for the representation, promotion and protection of the interests of this category of the population. In turn, employers’ organizations can also cooperate and form associations of organizations. In 2012 the Law “On Employers’ Organizations, their Associations, Rights and Guarantees of their Activities” was adopted, which contains many gaps and inaccuracies, which in practice leads to certain difficulties with the registration procedure. The founders of an employers’ organization can be either enterprises or individual entrepreneurs (FOP) who employ hired labor.
Documents for registration
The following documents are submitted to the registration authority:
- completed registration card;
- decision on the establishment of the organization (minutes) together with the register of meeting participants;
- two copies of the charter.
When creating an association of organizations, the following are also submitted:
- decision to form the association, adopted by the management bodies of the organizations;
- extract from the Unified State Register, certified by the signature of an authorized person of the organization (copy).
Employers’ organizations and their associations operate primarily through membership, entrance and targeted contributions from their member employers.
Procedure for registering an employers’ organization
An employers’ organization can be created with one of the following statuses: local, regional, republican, all-Ukrainian.
The above documents are submitted to the relevant structural subdivision of the Ministry of Justice depending on the status and location of the organization.
The period within which registration must be completed cannot exceed 15 days, except in cases where the submitted documents are found not to comply with the established requirements.
Employers’ organizations and their associations may, in the manner provided by law, register their own symbols.
Employers’ organizations and associations have the right to create their own legal entities and carry out economic activities to achieve their goals.
