A public organization is one of the forms of association of citizens, whose founders and participants are individuals.

Since 2013 a new Law of Ukraine “On Public Associations” has been in effect, according to which the creation of a public organization takes place under new rules. The mandatory territorial dependence of an organization (local, nationwide, international) has been abolished and the principle of free choice of the place of activity has been established, meaning that today the territory for the activities of public associations is the whole of Ukraine. However, a public organization, at its own option and subject to certain requirements, may obtain nationwide status.

Documents for registration of a public organization

An organization may be established as a legal entity or without such status; the required list of documents depends on that.

General list of documents:

  • an application of the prescribed form;
  • a completed registration card;
  • minutes of the founding meeting;
  • two copies of the charter;
  • information about the governing bodies and the representative (together with their consent);
  • a (legalized) document confirming the registration of a foreign legal entity (if it acts as a founder).

It should be borne in mind that there are strict requirements for the form and content of the minutes and the charter, failure to comply with which leads to refusal of registration and the need for further revision of the document package. Therefore, in most cases the refusal of registration is precisely related to incorrect preparation of these documents.

Procedure for registration of a public organization

Registration of a public non-profit organization is carried out in accordance with the procedure for registering a public association.

The registration period for a new association is 60 days from the date of the founding meeting, during which the above-mentioned documents are submitted to the Ministry of Justice (local registration service authority).

The legalization procedure of a public organization is completed by entering its data into the Register of Public Associations, and in the case of creating a legal entity, also by entering data into the Unified State Register (EGR) and registering with the statistics authorities and the State Tax Inspectorate (GNI).

In addition, a public organization may approve its own symbols, which are subject to registration with the UkrStateRegister.

For a public organization to function with nationwide status, it is necessary to have separate subdivisions in the majority of the country’s administrative-territorial units. Confirmation of this status takes place annually.
