Change of organization and fund location

The change of a legal address can occur at the discretion of the governing body (for example, the organization decided to move to a more comfortable office). The change of the location address of a public and charitable organization is carried out in the manner specified in their founding documents and in accordance with the current legislation of Ukraine.

The establishment of a non-profit legal entity, a public association, or a charitable organization entails state registration at its location. Subsequently, the registration authorities enter the relevant information into the Unified State Register of Legal Entities and Individual Entrepreneurs (USR) in the form of data on the created legal entity. Such information also includes the legal address.

All the information contained in the USR is needed so that authorized bodies can quickly verify the accuracy of the information about a legal entity; it is also available to all participants in civil legal relations who can confirm the existence of a particular legal entity and identify it among many others.

All non-profit organizations that are already registered change their location by making amendments to their founding documents. This does not apply to legal entities that operate on the basis of the model charter approved by the Cabinet of Ministers. In public organizations and public unions, the change of the organization’s location requires the submission of a package of documents that contains:

• an application – drawn up in free form;
• a registration card intended for making changes to the legal entity;
• a document confirming the state registration of the legal entity – the certificate or its duplicate.

Changing the legal address of a legal entity requires the submission of documents that must be signed by the authorized person of the public association – the head. Documents are submitted in person or sent by mail.

If the location of a fund is changed (a fund is considered a charitable organization whose main activity is charity), then the registration card of form №3, completed taking into account the changes, is submitted or sent by mail with an inventory of enclosures.

When submitted (sent), this card must bear a mark indicating the date of its receipt, because it is this date that is entered in the register of registration actions.
