Messenger Registration of a loan from a non-resident with the National Bank of Ukraine
In today’s business world there is often a need to obtain funds from foreign sources. Companies look for new sources of financing in the form of foreign partners. International holding companies distribute funds among their divisions, which are separate legal entities. To achieve their goals, many business entities use lending. Non-resident may provide a loan to legal entities, to individuals who are citizens of Ukraine, and to individuals engaged in entrepreneurial activity, i.e., residents.
However, according to Ukrainian legislation, funds received as a loan from a non-resident cannot even be credited to an account in a Ukrainian bank without prior registration of the loan agreement with the National Bank of Ukraine. Such registration of a loan from a non-resident was introduced to give the NBU the opportunity to verify the transaction’s compliance with the foreign exchange control regime.
Our company provides the following services for loan registration:
- preparation of a package of documents for subsequent submission to the National Bank;
- assistance in preparing a letter from the servicing bank;
- obtaining the certificate of registration of the loan agreement in the NBU.
Documents required for submission to the National Bank of Ukraine:
- the original loan agreement or its draft; if the agreement is drawn up in a foreign language, a notarized translation into Ukrainian is desirable;
- a copy of the certificate of state registration;
- copies of the charter documents (for a legal entity);
- a certificate from the statistics office;
- a copy of the document (order) appointing the head of the legal entity.
It is also necessary to provide exact information about the name of the non-resident, its address and bank details.
Loan registration, if all formalities are met, takes up to 10 days, after which the applicant receives the certificate of registration of the loan agreement.
It should be remembered that all changes, both to the loan agreement itself and to the other data reflected in the certificate, must be timely registered with the National Bank of Ukraine.
