Why you may need a certificate of absence of a bankruptcy case:

  • participation in competitive bidding during a tender;
  • when considering court cases;
  • when concluding transactions at the request of your counterparties.

Let’s consider these cases in a little more detail.

The most common reason for obtaining such a certificate is participation in competitive bidding during public procurement of goods and services. This is due to the requirements of Article 17 of the Law of Ukraine “On the Implementation of Public Procurements”, which states that the procuring entity may prohibit a natural or legal person from participating in the procurement procedure if the potential participant has been officially declared bankrupt or if a criminal case regarding bankruptcy has been initiated against them. Thus, the presence of a certificate of absence of a bankruptcy case is a mandatory condition for participation in a tender.

Very often, when considering a case in court, whether commercial or civil, the court may request confirmation that your enterprise is not bankrupt and is not undergoing bankruptcy proceedings.

In addition, recently, due to the rise in economic crimes and the corresponding distrust among business counterparties, cases have become more frequent where, in order to conclude a large financial transaction, future partners try to secure themselves and require mutual provision of certificates confirming the absence of bankruptcy proceedings.

Thus, this document is necessary for conducting many business affairs and for the successful development of a business.
