Liability for non-payment of wages

If the owner or authorized body did not settle accounts with the employee within the time limits established by Art. 116 of the КЗоТ, such actions entail the liability provided for in Art. 117 of the КЗоТ, i.e., the employer must pay the employee the average monthly earnings for the entire period of the payment delay.

This conclusion was made by the Supreme Court of Ukraine in its ruling of 29.01.2014 No. 6-144цо13 after considering the case on recovery of the average monthly earnings for the period of delayed payment and compensation for moral damages.
