How to obtain a subsoil use license?
License for the Right to Use Subsoil
The issuance of a license for subsoil use is carried out through auctions or, in legally established exceptions, without them.
A license for the right to use subsoil is required for the following types of activities:
- implementation of production sharing agreements;
- extraction of mineral resources;
- geological exploration and development of deposits;
- installation and use of underground structures that are not intended for mineral extraction;
- creation of geological objects of important scientific, cultural, and health-sanitation significance.
The cost and payment procedure for the license are calculated by a special methodology and depend on the initial sale price of such permit.
The license is issued for a specific period, the duration of which depends on the particular type of activity. Extension of this period is possible provided the licensee has not violated their obligations.
Reissue of the license is required in the event of:
change of name or full name;
change of location or place of residence;
- acquisition of the entire property complex of a state coal-mining enterprise (under lease or concession).
License for the extraction of mineral resources
It is important to remember that a license for the extraction of mineral resources (or the industrial development of deposits) is issued after the mandatory conduct of expertise and evaluation of explored reserves or the approval of forecast resources by the State Commission on Mineral Reserves.
It should also be taken into account that a permit must be obtained for each type of activity. That is, the same entity must obtain a separate permit for oil production and a separate permit for gas production.
License for geological exploration of the subsoil
Legislation provides a special procedure for activities with minerals of strategic importance. A license for geological exploration of subsoil that are strategically important (and for their extraction) is granted only on the basis of a conclusion by the Interdepartmental Commission on Subsoil Use.
The legislation also establishes a list in which, depending on the type of subsoil use, the documents required for obtaining the permit are indicated. Therefore, the necessary list of documents depends on each particular case.
