BTI Certificate No.12 on the Absence of Buildings on the Land Plot

When transferring a land plot free of buildings, the notary is required to request a certificate confirming the absence of structures on the land plot.

Such a certificate can be obtained at the Bureau of Technical Inventory if the plot is located within city limits. If the plot is territorially located outside the city boundaries, the certificate is issued by the village council or the gardening association.

To obtain the certificate, a current inventory of the object must be carried out. A BTI representative, after reviewing the inventory file materials, visits the site and conducts a visual inspection of the plot within the established boundaries. If no structures are detected, after the period established by law has passed, the applicant receives a certificate confirming the absence of buildings on the land plot. If the BTI representative discovers unregistered structures, issuance of the certificate is refused. In that case, it is necessary to legalize the unlawfully built structure.

The law also provides other grounds for refusing to issue the certificate:

  • the application was submitted by an unauthorized person;
  • the applicant lacks title-establishing documents;
  • the employee conducting the inventory was unable to perform the inspection due to lack of access to the property.

Certificate confirming absence of buildings on the land plot is issued upon submission of the following documents:

  • a copy of the passport and identification code;
  • a copy of the certificate of state registration and the statistics certificate (for a legal entity);
  • a copy of the title document.
