Land ownership registration

Anyone can privatize a land plot in Ukraine. However, this procedure is quite long and labor-intensive. It is practically impossible to handle it on your own, so you should contact lawyers in advance. Land plot privatization

To privatize land means to obtain an official document of ownership for the selected plot. This procedure is carried out to register:

  1. Plots that are in the applicant’s use under a lease agreement or a state act.
  2. Land under a house owned by the applicant. This also includes privatization of a garden plot and others
  3. State and communal plots eligible for free privatization.

Free privatization is guaranteed by Ukrainian legislation. Although this concept is more conditional, since you will still spend a considerable amount to obtain the necessary certificates and specialists’ services. Nevertheless, every Ukrainian has the right to register a land plot for free. This category includes:

  1. Registration of land ownership for a farming enterprise in the size of 1 share (for members of agricultural enterprises).
  2. Registration of a land plot for personal farming (no more than 2 hectares).
  3. Privatization of a dacha plot for personal construction (no more than 0.10 hectares).
  4. Registration of plots for gardening (no more than 0.12 hectares).
  5. Privatization of household plots for finishing construction, maintenance of residential houses, utility buildings and other structures in villages (up to 0.25 hectares), settlements (up to 0.15 hectares), cities (up to 0.1 hectares).
  6. Registration of a land plot in ownership for garage construction (no more than 0.01 hectares).

Documents for privatizing a plot

If you need to privatize a land plot, you will initially require a small package of documents. Many certificates are obtained during the procedure itself. If your situation does not violate the law on plot privatization, you can confidently begin preparing the main set of papers. These include:

  • an application for plot privatization;
  • the owner’s Ukrainian passport and identification code;
  • property documents if there is any building on the plot;
  • documents for a legal entity (if necessary);
  • a notarized power of attorney for our employee if you do not want to be present when obtaining each certificate (issued by our company).

Land plot registration

Having the right of ownership to land and legalizing it are two different things. The procedure for privatizing a plot includes several rather complex stages and takes more than a month. In particularly complex situations the period can reach a year. In order not to delay the process and not spend a long time wondering where to start privatizing a land plot, contact professional lawyers in advance. In general, privatization has two conditional schemes of implementation, depending on whether the plot is in a citizen’s use. If it is, the land can be registered in ownership by completing the following steps:

  1. Submitting an application and the main package of documents (owner’s personal data and evidence of rights to privatization) to the state administration (city/settlement/village council) in accordance with the plot’s address.
  2. Waiting for the privatization decision (about 30 days). If it is positive, you will also be issued a permit to prepare all technical documentation to obtain rights to the land.
  3. Preparation of technical documentation and obtaining the act of ownership for the land plot. It should be noted that even if you qualify for free privatization, the service for obtaining certificates will cost from 1000 UAH.

If the land plot is not in a citizen’s use, privatization involves the following steps:

  1. Submitting an application indicating the size and intended use of the land to the state administration (city/settlement/village council), as well as the main package of documents.
  2. Waiting for permission to prepare a land management project (about 30 days) and its preparation. It is worth noting that the development cost is several thousand UAH, depending on the situation.
  3. Approval of the project with the commission created by the state administration or city council.
  4. Conducting a state expert review of your project.
  5. Project approval and provision of the plot into private ownership.
  6. Preparation of technical documentation. The cost of certificates depends on the plot and urgency.
