How to obtain a tour operator license?
Tourism Activity License
According to Ukrainian legislation, tourism is a temporary journey of a person (for a period from 24 hours to 1 year) aimed at fulfilling recreational, educational, professional-business and other interests, during which paid activity at the place of the tourist’s stay is not carried out.

The tourism activity license is issued by the State Agency for Tourism and Resorts.
Documents that must be submitted to the licensing authority:
- an application in the prescribed form;
- a bank guarantee (or a guarantee from another credit institution) for financial assurance of the applicant’s liability (notarized copy);
- a contract for compulsory medical insurance and accident insurance for tourists (copy, each page of which is certified by the signature of the head);
- necessary information about the premises (owned or leased);
- an inventory of the document package.
Legislation provides for the compulsory uninterrupted financial civil liability coverage of tour operators and travel agents. A travel agent is liable for damage caused to a tourist in the event of their insolvency (or the initiation of bankruptcy proceedings) related to the need to reimburse the cost of services that were stipulated in the contract but were not provided. In addition, a tour operator is additionally liable for expenses related to returning the tourist to their place of residence (stay).
The minimum amount of financial guarantee is established by law as follows:
- for a tour operator:
- providing a full range of services – 20 000 euros;
- operating exclusively in domestic and inbound tourism – 10 000 euros;
- for a travel agent – 2 000 euros.
Travel Agent License
As of 16.11.2010 the travel agent license was abolished. Currently only the business activities of tour operators are subject to mandatory licensing. To operate as a travel agent, a business entity only needs to enter in EGRPOU the type of activity under KVED – “Activities of travel agencies” (code 79.11). Afterwards the travel agent must follow Ukrainian tourism legislation and other regulatory legal acts. The agent’s activity is carried out on the basis of a written agency agreement with a tour operator.
Tour Operator License
Ukraine, through state authorities, exercises control over the activities of entities providing tourist services by licensing, standardization and certification of these services.
The tour operator license is issued only if the established licensing requirements are met. In particular, the permission is not granted if the name of the business entity is identical to the name of another entity that previously obtained a license. In addition to the requirements set out above for tour operator activities, the following can also be highlighted:
- a tour operator may engage exclusively in tourism activities;
- a tourism service agreement may be concluded in written or electronic form;
- the keeping of certain statistical records is mandatory;
- the head of the enterprise (branch, subdivision) must have higher education and at least 3 years of work experience in the field of providing tourist services, or a specialized higher education. Moreover, at least 30 % of the staff must meet the same requirements.
The fee for a tour operator license is set at the level of one minimum wage and as of 1.12.2015 amounts to 1,218 UAH. The license is valid indefinitely.
