Business activity involving wholesale or retail trade of pesticides and agrochemicals, due to the toxicity and a certain level of hazard of these substances, is subject to mandatory licensing.

Obtaining a pesticide license

Ukrainian legislation provides organizational, qualification and other special requirements in the field of circulation of pesticides and agrochemicals, therefore obtaining a pesticide license implies that the business entity complies with these requirements.   • availability of warehouses, trading premises and material and technical base that comply with licensing requirements;
  • permits (certificates) of employees authorizing work with pesticides and agrochemicals (copies).

Considering that the trading procedure entails the generation of toxic waste, the list of documents must also include a guarantee letter regarding their disposal.

The licensing requirements also include the following:

  • trade is carried out through warehouses (with sanitary passports) or trading premises (with conclusions from the sanitary-epidemiological service (SES));
  • a permit to start work (in the field of fire supervision) is mandatory;
  • the licensee must maintain certain statistical records on the substances it trades;
  • sales are carried out in small packages;
  • the licensee must provide the buyer with full information on each item (method of use, duration of effect, precautionary measures, etc.);
  • employees involved in the trade must have authorization for such work, a certificate of having completed the necessary training and an appropriate medical book.

The cost of the license until 1.12.2015 is 1218 UAH. Validity period – unlimited.

License to manufacture pesticides

Pesticides (excluding copper sulfate, sulfur and colloidal sulfur) are included by legislation in the list of particularly hazardous chemical substances, therefore their manufacture requires a pesticide manufacturing license issued by the Ministry of Ecology and Natural Resources of Ukraine.

For a positive decision on the issuance of this permit, the business entity must have:

  • appropriate regulatory and material-technical base;
  • conclusions from supervisory authorities (in the fields of labor protection, fire safety and sanitary-epidemiological safety);
  • certificate (attestation) of state registration of a hazardous chemical factor.

The license is granted for a term of 5 years. The cost of the license is set at the level of one minimum wage and for 2014 amounts to 1218 UAH.
