What is an invention or a utility model?
A patent is a result of intellectual (creative) activity enshrined in legislation. It can be a product, process, model, technology, or substance.
It must have the characteristics of usefulness and novelty for society; the invention must also be suitable for implementation in production and demonstrate “usefulness”, novelty and an inventive level.
How does a utility model differ from an invention?
In general, registering a utility model is more advantageous than obtaining a patent for an invention. The requirement of inventive level applies only to inventions. For a utility model it’s simpler, for example, you wipe windows with a newspaper — it’s obvious to you, BUT such a wiping method is not described or registered anywhere — a world discovery, but obvious to you.
It is easier procedurally and cheaper to register a utility model.
A patent is not granted under the following conditions:
- the patent contradicts established norms of morality, humanity and public interest;
- breed of an animal;
- plant variety;
- topographies of integrated circuits;
- the result of artistic design.
