In which cases a Certificate of Ownership for land is issued

Since January 1, 2013, a number of innovations in the field of land relations have been in effect in Ukraine. One of them is a title-establishing document – the Certificate of Ownership for a land plot. This was done to simplify the exercise of land ownership rights. The Certificate of Ownership is issued after state registration by the agency Ukrgosreestr.

The Certificate of Ownership for a land plot is issued only in the case of the initial establishment of ownership rights:

  • when a land plot is allocated from the lands of the state or communal fund;
  • when a plot is formed by dividing or merging a previously formed plot.

In the foregoing cases the process of formalizing the ownership right to a land plot involves two stages:

  • Registration of the land plot itself with the State Land Agency of Ukraine.
  • Registration of the ownership right to the land plot with the State Registration Service of Ukraine.

The legislator has provided that all previously issued state acts on land remain in force and do not require re-registration. When ownership is transferred, a transaction is concluded before a notary, and the State Act is attached to the contract. A note about the transfer of ownership is made on the act itself.

To obtain the Certificate of Ownership for a land plot, the following documents are submitted:

  • an extract from the land cadastre;
  • a decision approving the land management project by the executive authority or the local self-government body;
  • in the case of division or consolidation of a land plot, it is necessary to present the title-establishing documents for the previously formed plot.

If you want to sell or gift a plot, to conclude the transaction you will need to present the certificate of ownership of the land. Also, do not forget that now all land transactions occur only after a cadastral number has been assigned to the plot.
