Each year more people are interested in the question of how to open a school. Therefore, let us consider in more detail who can open an educational institution and what needs to be done.
If you intend to open a school, you need to arm yourself with the legal framework, primarily legislation on the registration of legal entities and individual entrepreneurs, as well as regulatory acts related to education.
Who can open a school in Ukraine
The right to open a school belongs to any natural or legal person, i.e., state authorities, local self-government bodies, enterprises, institutions, organizations regardless of their form of ownership, and even public associations, including religious organizations.
School registration procedure
The registration procedure depends on who is the founder of the school. If, for example, the educational institution is created by a legal entity, the certificate of registration (now – Extract) is submitted to the state registrar, and if by an individual – the identification code. However, the legislation defines a list of mandatory actions for registering a school:
- Choose a name and a legal form (for example, a limited liability company). Most often the organizational form is a private organization, institution or educational establishment. Depending on your choice, the registration procedure changes.
- Make a decision to establish the educational institution.
- Obtain a license to carry out activities for providing education services and training specialists of various qualifications.
- Hold a founders’ meeting to resolve issues regarding the location (legal address) and the appointment of the head. At the same meeting the charter must be adopted (this document must be approved by the central executive authority as well as local self-government bodies).
- Undergo the state registration procedure. For this, documents are submitted to the registrar, which are thoroughly checked. If there are no remarks, the registrar enters the information into the EGR and issues an Extract confirming the state registration.
Documents that must be submitted to register a school:
- registration card of the appropriate form;
- charter in two copies (preferably notarized);
- founders’ decision to create the school – Minutes of the founding meeting;
- if the documents are submitted by the head, submission of the passport is required;
- if documents are submitted by a representative, in addition to the passport, a power of attorney must be provided to the state registrar.
The package of documents may vary depending on whether a legal entity or an individual is creating the school.
