Court proceedings on the infliction of bodily injuries

How much compensation can be claimed for inflicting serious bodily injuries?

Articles 121-128 of the Criminal Code describe the possible types of bodily injuries. The main classifiers of such crimes are the degree of guilt and the severity of the bodily injuries.

The most serious act in this category is intentional serious bodily injury, and the least serious is intentional minor bodily injury and serious (moderate) injury caused by negligence. In addition to receiving a certain measure of punishment (fine, community service or restriction of freedom), the guilty party must necessarily compensate the victim a certain amount of compensation.

If you have become the injured party, we want to warn you right away that obtaining a decent amount of compensation from the defendant is not that easy. First, you should know what can be included in such compensation. The Civil Code states: you may demand recovery of medical expenses, compensation for moral and material damage (if such damage occurred).

In court proceedings on the infliction of bodily injuries civil claims from the injured party are very often included. That is, the amount of compensation for such a person is determined within the framework of the criminal proceedings (although filing a claim is not prohibited after the decision in the criminal proceedings has been issued). Despite the fact that the law is almost always on the victim’s side, proving the defendant’s guilt is not easy. The plaintiff is required to submit many pieces of evidence to the court (medical certificates, documents from the workplace, calculations of the compensation amount, etc.).

Particular difficulties arise when substantiating moral damage, since it cannot be measured quantitatively. Only an experienced legal expert can justify each item of your claims against the defendant. Our lawyers know how to conduct themselves during court proceedings, as well as how to correctly recover material and moral damages from the defendant.
