If a structure of IV–V complexity category is planned on a land plot, a building permit for the house must be obtained before starting work. The mechanism for dividing construction objects into complexity categories is established at the legislative level; it is based on a classification of the consequences in the event of a building’s collapse: how many people could be harmed, the monetary amount of losses, whether the collapse could disrupt transport, communications, energy supply, or result in the loss of cultural heritage sites. The category itself is determined by the project client or the person responsible for design.
Obtaining a permit to construct an object of IV–V complexity category not only grants the right to begin actual construction works; without it you cannot even carry out preparatory works or connect the building to engineering networks.
Procedure for Obtaining a Building Permit
After submitting an application to the State Architectural and Construction Inspectorate (GASI), the issuance of a building permit must occur within 10 days. If all construction works are carried out by a single contractor without involving subcontractors, no other permits are required for carrying out any construction works and removal of green plantings.
To obtain a building permit for a private house, the following documents must be attached to the application:
- a document confirming the applicant’s rights to the specific land plot;
- the design documentation for the construction project that has already been approved;
- a copy of the license granting the right to carry out construction works;
- a copy of the orders appointing the persons responsible for carrying out the construction activities and assigning them duties for carrying out author and technical supervision over the progress of construction.
The application and its accompanying documents must be reviewed by an inspector within 10 days, after which either a permit is issued or a reasoned refusal is sent to the applicant. The grounds for refusal are clearly defined by law. These include submission of an incomplete set of documents or their non-compliance with legal requirements, as well as the discovery of false information in the submitted documents.
But direct issuance of a permit to carry out construction work is not always necessary. If, within the allotted time, the inspectorate has neither refused nor issued the permit, it is considered to have been issued, and therefore construction may commence.
If the landowner or the contractor who applied for the permit changes, it must be reissued by the authority that issued it. Reissuing implies repeating the permit obtaining procedure. If the persons responsible for author and technical supervision change, the authority that issued the construction permit must be notified. Such a notification is made in two copies, one of which is sent to the inspectorate and becomes part of the permitting documentation, the other remains with the applicant.
Obtaining the permit imposes additional obligations on the applicant to notify local authorities and fire and industrial safety bodies about the start of construction works. In turn, local authorities must inform residents about the start of works through the mass media.
A permit may be revoked in the following cases:
- if the applicant themselves has submitted a request for revocation;
- in the event of the applicant’s death or liquidation if the applicant is a legal entity;
- in the case of repeated obstruction of an inspection by a GASI representative.
If a permit was not obtained for the construction of an object, such an object is considered an unauthorized construction (self-built), which entails liability as established by law.
