UNFORTUNATELY, AUTOMOTIVE LEGAL SERVICES ARE TEMPORARILY NOT PROVIDED BY OUR COMPANY.

On August 14, 2011, the Law of Ukraine (“On Amendments to Certain Legislative Acts of Ukraine regarding the Elimination of Excessive State Regulation in the Field of Road Transport” No. 3565-17 of 05.07.2011) came into force.

This regulatory act introduced the following changes regarding technical inspection:

  • the procedure of state technical inspection for certain categories of vehicles has been canceled;
  • for vehicles for which inspection is mandatory, the procedure has been changed (without the participation of the state traffic police);
  • “technical inspection” was renamed to “technical control”;
  • the inspection certificate was replaced by the “protocol of technical control”, which is a strict reporting form with security elements;
  • for vehicles subject to technical control, when obtaining auto civil liability insurance (OSGPO) the protocol of technical control is required. The validity period of the auto liability insurance is limited by the date of the next mandatory technical control.

By the CMU Resolution (“On Approval of the Procedure for Conducting Mandatory Technical Control” No. 137 of 30.01.2012) the procedure for conducting technical control (formerly – technical inspection), the form of the technical control protocol, and the requirements for organizations that perform technical control (inspection) were approved.

For those who already underwent mandatory technical inspection in 2010 or in the period from January to June 2011, and who fall under mandatory inspection, it is not necessary to undergo it again until the validity of the received inspection certificate expires.

Table to determine the necessity of undergoing technical control (inspection)

First, it is necessary to determine whether undergoing technical control (inspection) is mandatory for your vehicle. The following table will help:

The following documents are required to undergo technical control

for the vehicle:

  • registration documents confirming the right to use the vehicle (vehicle registration certificate, temporary vehicle registration certificate, other);
  • for vehicles running on gas fuel, an additional document is submitted confirming that the gas installation tests were carried out in the manner and within the timeframes established for this type of equipment and its configuration;
  • for vehicles equipped with special sound and/or light signals, permission for their installation and use is required;
  • for vehicles transporting dangerous goods, an additional certificate of admission of the vehicle to such transportation and a certificate of completion of special training by the drivers of such vehicles are submitted.

for the vehicle owner:

  • for individuals: passport of a citizen of Ukraine or another identity document; for legal entities: a power of attorney from the legal entity to the person (not notarized) who will pick up the protocol of technical control (with their specimen signature), and for contract preparation – a copy of the certificate of state registration, VAT payer certificate, bank details;
  • The medical certificate for passing the technical inspection was canceled from 31.01.2011 by CMU Resolution (“On Amendments to the Procedure for Conducting State Technical Inspection of Wheeled Vehicles” No. 100 of 31.01.2011).

Procedure for undergoing technical inspection

Technical inspection has been replaced by technical control, in accordance with the Law of Ukraine (“On Amendments to Certain Legislative Acts of Ukraine regarding the Elimination of Excessive State Regulation in the Field of Road Transport” No. 3565-17 of 05.07.2011). In the process of technical control the state traffic inspectorate does not participate, and the whole procedure is reduced only to obtaining the technical control protocol at an accredited (licensed) service station (STO). Moreover, the technical control can be carried out at a service station that previously conducted vehicle inspections (for 1 year after the Law came into force), as well as at a service station that received the appropriate license according to the new Law.

Before undergoing technical control, it is recommended to visit your “home” service station (STO), check and repair the vehicle according to the following items: braking system, condition of steering (steering play must not exceed 10 degrees), functioning of external lighting devices, light transmission of glass, windshield wipers and washers, condition of wheels and tires (tread depth), compliance with emission standards, leakage of fluids, presence of a first aid kit, fire extinguisher, emergency stop sign.

Average prices for undergoing technical control in Kyiv

  • Passenger cars – 120 ;
  • Trucks (up to 3.5 t) – 150 ;
  • Minibuses (up to 5 t.) – 200

After undergoing technical control, the vehicle owner receives the “protocol of technical control”. According to this protocol, within 45 days it is necessary to obtain an auto civil liability insurance policy.

Auto civil liability insurance (OSGPO)

If your vehicle is subject to mandatory state technical control, a protocol of technical control is required to obtain a compulsory civil liability insurance policy. Policy prices are set out in Ukrainian legislation and are the same across all insurance companies. The cost of insurance depends on: type of vehicle (carrying capacity, engine volume, number of seats), region of vehicle use (by population size), policy duration and its type.

If you concluded a civil liability insurance contract before the Law of Ukraine (“On Amendments to Certain Legislative Acts of Ukraine regarding the Elimination of Excessive State Regulation in the Field of Road Transport” No. 3565-17 of 05.07.2011) came into force, then such a contract continues to be valid until its expiration.
