Regarding innovations in the field of licensing in 2013.

The Verkhovna Rada prepared some registration and licensing adjustments, in particular it was envisaged to amend certain laws, for example:

Law “On Licensing of Certain Types of Economic Activity” (No. 1775-III of 01.06.2000), according to which the legal provision that required the submission of an extract from the Unified State Register was abolished.

1.  Law “On Licensing of Certain Types of Economic Activity” (No. 1775-III of 01.06.2000). According to the amendments:

a) the requirement to submit an extract (from the Unified State Register of legal entities and individual entrepreneurs when filing an application for a license) is abolished

b) the grounds for refusal to grant or to revoke a license have increased:

  • if there is no information about the applicant in the Unified State Register (submission of Form 6 — confirmation of legal entity status — is becoming increasingly mandatory for entrepreneurs)
  • if the Unified State Register indicates that the legal entity is in the process of termination by liquidation; (termination of entrepreneurial activity of an individual entrepreneur)

2. Law “On State Registration of Legal Entities and Individual Entrepreneurs” (No. 755-III of 15.05.2003).
In the amendments introduced to the law attention should be paid to the following:
a) the duties of state registrars now include:

  • entering information about legal entities and individual entrepreneurs necessary for the issuance of permit documents and licenses. Therefore, the annual submission of Form 6 is mandatory for enterprises whose types of activities are subject to licensing.
