What could be worse than eviction from housing? Although, as a general rule, every citizen has the right to housing, the Housing Code provides rules that allow the eviction procedure to be carried out.

Thus, eviction from residential premises can be carried out in the following order:

  • voluntarily;
  • on the basis of a court decision;
  • on the basis of a prosecutor’s sanction (in case citizens live in a house that is in an emergency condition, or if they have occupied any residential premises without authorization).

As a rule, evicting residents from their own housing is impossible without providing them with alternative housing. But, unfortunately, there are exceptions to this rule. The eviction procedure may be carried out without providing other housing. Let’s examine this option in more detail.

Recently many citizens purchase housing on credit. There are, undoubtedly, advantages (you do not have to wait years to move into your own apartment or house) and disadvantages (loss of housing if financial problems arise). So, if a citizen accrues a loan debt, the provided mortgaged housing is subject to foreclosure. Such foreclosure can take place in a pre-trial procedure, and if the residents do not vacate voluntarily, eviction is carried out on the basis of a court decision. But even in this case not all is lost. In some cases evicted residents may be provided with temporary housing.

Eviction can also be carried out not through the fault of the residents. Citizens may be evicted from residential premises with the provision of alternative housing in cases such as:

  • if the house in which the residents live is subject to demolition;
  • the house is in an emergency condition;
  • the house is to be converted to non-residential use;
  • in other cases.
