A share contribution is additionally paid under an agreement with the Department of Urban Development and Architecture of the executive body of the Kyiv City Council. The cost depends on the area of the structure and possible issues during processing.

To start work, you must send the documents to the email office@nakaz.com.ua:


  1. Address, district
  2. Area of the site
  3. Photographic documentation of the site from a distance of 5-10 meters, 5-7 photos from different angles
  4. A point on the map showing exactly where the Summer terrace is located
  5. Documents for the premises to which the Summer terrace adjoins (lease, proof of ownership)
  6. Charter documents (LLC, individual entrepreneur) under which the information card will be issued
  7. Previously obtained documents for the summer platform (if available)

The validity period of summer platforms is from May 1 to October 30.

Installing summer terraces in Kyiv is quite a profitable business, but seasonal. Therefore, you need to prepare to obtain a permit in advance.

To obtain a permit for a Summer terrace independently, you must complete the following steps:

  1. Check whether the area you have chosen meets the requirements listed below.
  2. Collect a package of documents
    • photographic documentation of the site
    • documents proving the lessor’s ownership rights
    • the tenant’s lease agreement
    • tenant’s charter documents
    • previously obtained permit documents (if any)
  3. Submit the documents to the Department of Architecture and Construction of Kyiv
  4. Agree on all necessary matters
  5. Receive the Contract and invoice for payment within 2 weeks
  6. Pay the invoice
  7. Receive the information card as the final document

Below are the requirements for the installation of Summer structures.

2.1 Installation of terraces is permitted only next to stationary restaurant facilities.

2.2 Terraces on alleys, sidewalks and pedestrian paths must be installed so that at least 1.8 m remains for pedestrian movement. The presence of the terrace should not be an obstacle to the free passage of pedestrians.

2.3 The installation of the terrace is carried out exclusively within the facade limits of the restaurant facility. At the same time, passages to entrance or driveway gates of houses must remain free. In some cases, the installation of terraces whose linear dimensions exceed those of the establishment itself is allowed. This is done with the written permission of the tenants or owners of adjacent structures.

2.4 Terraces must be mounted so that persons with disabilities can have unobstructed access to them.

2.5 The installation of lighting equipment should be carried out on the terrace area. At the same time, fixtures (lamps, lights, etc.) are mounted in such a way as not to dazzle the establishment’s visitors, drivers of passing vehicles, and not to illuminate the windows of apartments or private houses.

2.6 The terrace must be sturdy and safe. Its construction must comply with the safety requirements applicable to such structures.

2.7 Alteration of the building’s load-bearing structures during the construction of the terrace is not permitted. The terrace must be easily and quickly dismantled if necessary, for example during building repairs.

2.8 The following objects are allowed to be installed on open terraces:

  1. Decorative elements.
  2. Benches, chairs and tables.
  3. Lamps.
  4. Trash bins.
  5. Umbrellas.
  6. Landscape arrangements.
  7. Refrigeration equipment.
  8. Equipment for maintaining optimal air temperature.

 

2.9 It is permitted to install small prefabricated/dismountable objects around the perimeter of the terrace. Their height must not exceed 1 m. Such structures are usually used to install lights or flower arrangements.

2.10 The arrangement of terraces on the territory of historical and cultural reserves, in the protection zones of historical monuments and houses that are monuments of local or national importance is permitted. When designing such terraces, artistic and technical solutions that fit into the existing historical environment must be used. Such objects must meet a number of requirements:

  1. When constructing terraces, the unity of facades must be observed. It is necessary to take into account the style of the building’s exterior finishing. Structural composition should not be disrupted.
  2. Architectural details and facade decor must be perceived the same as before the terrace was erected. Terraces should be placed in such a way that they do not cover architectural elements of the facades (columns, pilasters, mosaics, stucco, etc.).
  3. Awning canopies may be used as sun protection elements on summer terraces. Their attachment is carried out directly to the facade and to supports placed next to the facade. The main requirement is that they should not obstruct facade decor.

 

2.11 The installation of terraces is prohibited:

  1. On alleys, sidewalks and pedestrian paths if it hinders the unobstructed passage of people.
  2. On motor roads.
  3. On lawns and green plantings.
  4. If it creates a threat to people’s health and life.
  5. Closer than 20 m from the plane of door openings in the evacuation direction with the center at the middle of the door group which includes doors marked «Entrance» or «Exit». In the case of underground passages without doors, the measurement should be taken from the center of the plane of the edge of the last step.
  6. At a distance of less than 20 m from road signs indicating a public transport stop.
  7. On artificially erected structures. The ban is lifted if such placement of the terrace is provided by the project in compliance with the established procedure.
  8. Closer than 100 m from a railway crossing.
  9. Closer than 20 m from street intersections.

 

2.12 The installation of stages, platforms, dance floors, barbecues, grills, etc. is not allowed on the territory of summer terraces.

2.13 If the open terrace is located within a residential development, the use of sound reproduction equipment and live music is prohibited.

2.14 If the terrace is located near the roadway, protective structures must be provided on that side to protect visitors from accidental vehicle collisions.

2.15 If the construction of a terrace is planned on a land plot owned by a third party, it is necessary to obtain written permission for construction from the owner.

2.16 Placement of seasonal terraces in protection zones of engineering communications is permitted only after coordination with the owner of these communications.

2.17 The organization of the terrace’s operation may begin only after signing the agreement on payment of the shared contribution in accordance with the Procedure for determining the volumes of shared participation.
