IMPORTANT: from January 1, 2015 the trade patent is canceled. One of the innovations of the Law of Ukraine “On Amendments to the Tax Code of Ukraine and some legislative acts of Ukraine regarding tax reform” dated 28.12.2014 No. 71-VIII is the abolition of the fee for carrying out certain types of entrepreneurial activity.

Business entities in Kyiv and across Ukraine, to carry out certain types of activities in the fields of retail trade, entertainment, provision of paid household services, as well as currency exchange, are required to obtain a trade patent and pay the prescribed fee for it.

How to obtain a trade permit?

Before obtaining a trade permit, you should consider how reliably you can ensure a positive outcome in this procedure on your own. After all, how professionally the application is prepared for the state authority determines how quickly you will receive the finished patent.

Retail trade license

A permit certifying the right to trade and conduct certain activities is issued based on an application submitted by the business entity to the supervisory authority. The following information is indicated in this application:

  • the name of the legal entity and the EDRPOU code or the surname, first name, patronymic, and identification number of the individual;
  • address of the business entity or its separate subdivision;
  • type of activity and the patent;
  • the period of time for which the patent is to be obtained;
  • name of the payment document;
  • name and address of the premises where the activity will be carried out according to the permit (or an indication that the trade is “mobile”);
  • name, number and date of the document granting the right to use the premises.

Documents confirming the accuracy of the provided information must be attached to the application.

It should be remembered that tax legislation exempts certain business entities from the obligation to obtain a patent. In particular, these include state and communal pharmacies, as well as individuals engaged in market trading.

Sales license

Obtaining a patent is mandatory for each separate point where sales, service provision, or currency exchange are carried out. It is important to remember that displaying the patent (or its copy) at the place of trade must provide open access for inspection. Depending on the specific type of activity, the business entity may acquire:

  • a trade patent. Acquired for a term of 60 calendar months. Its cost is determined by local self-government bodies taking into account the minimum wage. Payment is made by the 15th day of the month preceding the reporting month;
  • a preferential patent. Acquired for trading in goods specified by legislation. For example, medical devices for individual use, domestically produced medicinal products, food products. The patent’s validity period is also 60 calendar months. The cost is paid annually in the amount of 0.05 of the minimum wage;
  • a short-term trade patent. Applied for trading at short-term events, such as fairs, exhibitions. It has a validity period from 1 to 15 days. The cost of the patent per day is 0.02 of the minimum wage. Payment is made 1 calendar day before the start of trading;
  • a patent for activities in the field of entertainment. This refers to the provision of services for organizing paid entertainment games (billiards, bowling, slot machines). The permit is acquired for 8 calendar months, separately for each gaming place. The cost ranges from one to two minimum wages and is payable quarterly, by the 15th day of the month.
