Rules for Property Registration in 2014 Will Be Changed
According to a comment by the Minister of Justice, Elena Lukash, in 2014 the procedure for state registration of rights to real estate will take place under a new and significantly simplified system that provides for the removal of unnecessary obstacles and the improvement of the procedure’s quality for individuals and legal entities.
According to a comment by the Minister of Justice, Elena Lukash, in 2014 the procedure for state registration of rights to real estate will take place under a new and significantly simplified system that provides for the removal of unnecessary obstacles and the improvement of the procedure’s quality for individuals and legal entities. These changes come into force together with the resolution of the Cabinet of Ministers of Ukraine “On Approval of the Procedure for State Registration of Rights to Immovable Property and Their Encumbrances and the Procedure for Providing Information from the State Register of Rights to Immovable Property”.
The resolution provides the following innovations:
- Submission of documents for state registration of rights may be carried out either by the applicant’s personal submission or by sending them by courier or by mail;
- Registration of ownership and property rights arising from ownership is carried out simultaneously on the basis of a single application, which may be submitted by either the acquirer or the rights holder;
- State registration of rights is accompanied by the issuance of a certificate of title in place of damaged, spoiled or lost state acts of ownership of a land plot or certificates of ownership of real estate that were issued prior to the beginning of 2013 (currently the procedure is complicated by the lack of legal regulation);
- The registration procedure in state bodies that involves the construction or reconstruction of a property object with funds attracted from legal entities and individuals has also been significantly simplified (the documents required from the investor and the developer are clearly delineated);
- In the case of reconstruction or construction of a real estate object financed by cooperatives, state registration will be carried out based on a certificate submitted by the applicant confirming membership in the respective cooperative and that they have made a share contribution to the construction or reconstruction;
- Objects built during the Soviet era are also provided with the possibility of state registration of ownership rights as communal or state property;
- If an object is absent from the register, it is now possible to search for information about ownership rights to real estate in the registers that operated prior to the beginning of 2013;
According to the resolution, the new changes are to take effect on February 12, 2014.
