If an enterprise carries out both activity exempt from profit tax and activity taxed under the general regime, then income received from preferential operations is taken into account when determining the criterion – 10 million hryvnias.

This is stated in the Consolidated Tax Consultation on certain issues regarding the payment of monthly advance profit tax payments, approved by the order of the Ministry of Revenues of Ukraine dated 22.11.2013 No. 698.

The tax consultation also defines the specifics of enterprises’ payment of monthly advance profit tax payments when changing the taxation system, conducting insurance or patent-based activities and liquidating the enterprise, as well as the impact of audit results on the payment of advance payments.

In particular, a taxpayer cannot switch to quarterly reporting and stop paying advance payments (except in cases of no profit or incurring a loss).

Switching to the simplified taxation system (from the general system) in the middle of the year exempts the taxpayer from paying advance payments starting from the first month of the quarter of the reporting year in which the switch occurred.

Payment of contributions ceases upon liquidation of the enterprise (in the reporting period when the liquidation balance sheet is submitted.

The cost of trade patents is credited to reduce profit tax liabilities in the annual tax return.

Upon switching to the fixed agricultural tax (from the general taxation system), the taxpayer stops paying contributions from March. Accrued contributions for January – February are subject to cancellation or may be applied toward payment of another charge.

In case of non-payment or late payment of advance payments, corresponding fines are established: if the payment delay is up to 30 days – 10% of the debt amount; if the delay is over 30 days – 20%. In addition, for each day of non-payment penalty interest is charged at a rate of 120% per annum of the NBU discount rate.

Tax return figures adjusted as a result of audits are taken into account when calculating advance payments.
