Residential Complex Seven legal review

In this article we will talk about the 7th wonder of Osokorky – RC SEVEN. The complex is being built in the Darnytskyi district of the capital. It is only 550 m to the metro station, and nearby are the Arkadia shopping center and the newly opened RIVER MALL.

Convenient transport links, developed infrastructure and a new microdistrict, which is being actively developed further, make this complex quite popular.

COMPLETION DATE FOR RC Seven

Four buildings have already been completed and now the last two buildings are awaiting documents for commissioning. They were supposed to be delivered in Q1 2021, but Q2 has already begun and there is still no commissioning.

In the GASK registry by the developer code I found information that some documents for commissioning have already been submitted and are under review. At first I thought these were documents for commissioning the last two buildings, but the sales department told me that they had not even submitted documents for commissioning yet, allegedly due to the quarantine. Whether this is true I do not know, because documents can be submitted electronically. I won’t venture to say when the buildings will be commissioned — the first two phases of this complex were handed over with delays of 5-7 months.

THE BUILDER Stolitsa Group AND THE DEVELOPER

Usually people are familiar with the developer rather than the builder — the company that organizes and promotes the residential complex. You don’t have any contracts with the developer; they owe you nothing, but based on the developer’s recognition and reputation many choose projects. The developer of RC SEVEN is Stolitsa Group.

This company already has completed buildings in RC Galaktika, Varshavskiy microdistrict, Lipinka and the residential complex on Bohatyrska.

But another project of Stolitsa Group is RC Varshavsky+. There is various information about this complex on the Internet, including negative reports. Some say construction has stopped, while others claim that is fake news.

The builder is the company “Knyazhy Zaton”. The registry indicates that the company was registered in 1996 and its types of activity allow it to carry out construction; no debts of the company are listed in the registry. On the RC SEVEN website there is full information about all participants in the construction. There is also information about permitting documents, the text of the contract that must be signed when purchasing an apartment, and the planned commissioning date is indicated. Not all residential complexes provide such openness of information.

Everything is clear with the permit — it exists, it is valid and was issued for construction of 26 floors.

LAND for the residential complex Seven

The complex is being built on land plot 8000000000:90:009:0004, which belongs to the city of Kyiv. In 2016 the Kyiv City Council transferred this land to the developer on lease for 7 years. The lease is valid until October 2023. The designated purpose according to the Public Cadastral Map corresponds to residential development. There are also no seizures on the land.

RC Seven problems that can be avoided.

  • Unfinished construction. Only in Kyiv there are 70 unfinished projects. 18,000 apartments whose owners will not receive keys.
  • Long-term stalled projects. In Kyiv there are 8 well-known long-term projects that have been under construction for more than 12 years.
  • Mismatch between the finished project and the one advertised. This is when the developer said one thing but the result was another. Expected to see a luxurious children’s playground, but in reality three swings. The visualizations showed a green yard with mature trees and bushes, but in fact there is asphalt everywhere, dug-up patches of earth around the perimeter and some shoots instead of lush crowns. They promised a courtyard without cars, but ended up with parking at the entrance. The pictures showed a beautiful lobby and finished corridors; instead there are monotonous Soviet-style entrance halls. There are many examples.
