Messenger Conducting inspections for compliance with land legislation
The inspections will be aimed at monitoring compliance with the requirements of land legislation by business entities.
By order of the Ministry of Agrarian Policy, the Procedure for inspections related to compliance with Ukraine’s land legislation has been established
The inspections will be aimed at monitoring compliance with the requirements of land legislation by business entities.
The conduct of inspections and state supervision of compliance with land legislation by business entities falls on the State Agricultural Inspectorate and its territorial bodies.
The following timeframes for conducting inspections are also provided:
- The duration of scheduled inspections cannot exceed 15 working days, and in cases where the inspection concerns a small business entity, this timeframe must not exceed 5 working days;
- The duration of unscheduled inspections cannot exceed 10 working days, and 2 working days respectively for small business entities.
An unscheduled inspection may be carried out on the following grounds:
- Received complaints, appeals or statements from individuals or legal entities regarding violations of land legislation;
- If inaccurate information is found and confirmed in mandatory reporting documents;
- After receiving an application to conduct an inspection at the applicant’s own request;
- When it is necessary to verify orders issued to the business entity or other documents related to rectifying violations of land legislation;
- When mandatory reporting documents were not provided within the prescribed period without valid grounds or justified reasons.
The durations for conducting unscheduled inspections must under no circumstances exceed the established limits, and extension of the period in this case is not allowed. State inspectors cannot carry out a scheduled or unscheduled inspection without official identification documents, as well as without an assignment to conduct it.
