Inheritance in the occupied territories of Ukraine

How to obtain an inheritance located in an occupied territory of Ukraine, or if the decedent lived in an occupied territory?

You need to contact any notary in Ukraine and submit an application to accept the inheritance. This must be done within 10 months from the date of the decedent’s death (yes, previously the period for accepting an inheritance was 6 months, but due to the war it has been slightly extended).

However, I do not recommend leaving everything until the last moment. After all, the procedure for accepting such an inheritance will be somewhat more complicated.

First: A notary can open a probate case only if you have a Ukrainian death certificate for your relative or if data about your relative’s death exists in the Ukrainian Register of Vital Records. Otherwise, you will have to apply to the court to declare the person deceased.

Second: if you do not have the original documents proving ownership of the real estate (which is part of the inheritance), you will again have to apply to the court. And you will need a lawyer here.
