Obtaining urban planning conditions and restrictions for land development

In essence, urban development conditions and restrictions are a document that reflects the planning and architectural requirements both for the object itself and for its placement on the plot. This document is a primary component of the initial data. To obtain it, you need to apply to the Department of Urban Planning and Architecture of your city.

The following documents must be attached to the application:

  • a copy of the document confirming that the plot belongs to the applicant;
  • a situational layout indicating the location of the plot in free form;
  • extracts from the topographic-geodetic plan, urban planning or land cadastre;
  • photographs of the plot and its surroundings;
  • an urban planning calculation showing the technical and economic indicators of the future construction;
  • an application in the prescribed form;
  • a certificate from the cadastre or the current cadastral plan;
  • for reconstruction – a document of ownership, technical passport, consent of co-owners.

If the submitted documents reveal that the future construction object does not comply with the general provisions of the local urban planning documentation, this will be grounds for refusal to issue the requested documents. Urban development conditions and restrictions prepared at the applicant’s request are written in two copies. One is given to the applicant, the other remains in the Department of Urban Planning and Architecture, and the information from it is transferred to the urban planning cadastre.

The document has two components: textual and graphical. In turn, the textual part is also divided into general provisions and the actual urban development conditions and restrictions for the land plot.

The general provisions contain information about the applicant and disclose data about the land plot: its location and address, the target and functional designation, the plot area, the name of the object under construction and its purpose, as well as the technical and economic indicators of the construction.

The second part describes all the requirements imposed on the object under construction: the distance to the plot boundaries, the maximum height of the object, restrictions introduced due to laid communications, restrictions related to the architectural and cultural value of the built-up area, and others.

The graphical part contains, accordingly, graphical representations of the land plot linked to the land cadastre, the urban planning cadastre, the situational layout and the topographic-geodetic plan.
