Privatization of an apartment, room, plot, property into ownership in Ukraine

Privatization of housing in Ukraine is the transfer of ownership of a dwelling from the state to a private individual or a group of individuals. Legislation provides for free privatization of housing at a rate of 21 sq. m. per person. In addition, an extra 10 sq. m. is provided per family. If the living area is slightly larger, it is necessary to pay extra for the “excess” square meters.

Housing privatization

The law on housing privatization sets out the procedure for further actions during privatization and the documents that must be submitted to the relevant authorities. Privatization of an apartment and other housing involves submitting the main package of documents:

  • A standard application form. Signed by every family member or by those persons who are registered and permanently reside in the apartment.
  • A certificate of family composition (issued by the employees of the housing office (ZHEK) or another management organization).
  • Technical passport (if the registrant does not have it, it can be obtained from the BTI authorities).
  • Documents certifying the used or unused right of each registrant to privatize housing at their previous place of residence, if they changed it since March 15, 1993 (for example, passports indicating the used right to privatization).
  • Documents that grant the right to preferential conditions for housing privatization.
  • A certificate from Oschadbank.
  • A receipt proving payment for services for processing privatization documents.
  • A copy of the passport of each adult and a copy of the birth certificate of each minor family member.
  • A copy of the apartment order.

All the documents listed above are required to be submitted to the housing fund privatization office at the place of residence. The deadlines for housing privatization in Ukraine are arbitrary. However, from the moment each applicant is issued a housing payment slip, it must be paid within one month.

Privatization of property

As with housing privatization, privatization of property is the process of alienating property together with the land plot that is in state ownership. The property objects subject to privatization include the following:

  • state enterprises or other real estate objects;
  • shares, stocks, stakes;
  • objects of unfinished construction;
  • certain social and cultural facilities.

The procedure for privatization of property is fully described in Art. 11 of the Law of Ukraine “On Privatization of State Property“. According to this article, the law on property privatization provides for:

  • mandatory publication of each object in the official print publication of the state authorities and in the local newspaper;
  • adoption of a decision on privatization;
  • conducting an audit of the financial reports of the object being privatized (if any);
  • conducting an environmental audit (if necessary);
  • approval of privatization.

The privatization of municipal property is also carried out according to the general procedure provided by the Law on privatization. But according to Art. 60 of the Law “On Local Self-Government in Ukraine“, the exception for privatization or other methods of alienation applies only to that municipal property which, as a result, may reduce the volume or worsen the quality of services provided by the object to the local population.

Privatization of ownership

Privatization of ownership is the procedure of transferring ownership rights from the state, or from a natural or legal person to another natural or legal person. According to legislation in Ukraine, the main forms of ownership are:

  • state;
  • municipal;
  • private;
  • other forms.

The procedure for privatization is provided for in the relevant laws of Ukraine and can be carried out by:

  • gratuitous transfer of rights to ownership;
  • sale of rights to ownership;
  • by registering ownership rights with the appropriate authorities.

It should be noted that privatization of private property occurs only when there are no documents for the real estate. But in such a case it is no longer about privatization, but rather about the formalization of the appropriate documents that can legally confirm the ownership of an individual.
