Re-registration of land ownership rights

First, let’s distinguish two often-confused concepts: «state registration of a land plot» and «state registration of rights to a land plot».

Registration of a land plot means entering information about the land plot into the land cadastre and assigning it a cadastral number.

Registration of ownership and use rights to land plots is the official confirmation of such legal facts as the emergence and termination of a right, as well as the transfer of rights.

According to the law, in land relations ownership rights, as well as usage rights, are acquired as a result of undergoing state registration of such rights.

In order for an owner or user to freely dispose of a land plot, he must register his right. When concluding exchange or sale and purchase transactions, when inheriting, when gifting, when leasing land, when obtaining a building permit, the certificate of state registration of rights to land must be presented along with the title document.

State registration of ownership and use rights to land plots is carried out upon submission of the following title-establishing documents:

  • civil-law contracts (lease agreement, sale and purchase agreement, exchange, donation);
  • certificate of the right to inherit;
  • certificate of ownership;
  • state act on the right of ownership;
  • state act on the right of permanent use;
  • court decision;
  • other documents confirming the transfer, emergence or termination of rights to the land.

The procedure for state registration consists of the following steps:

  • document verification;
  • making a registration decision if no grounds are found for suspending registration or refusing registration;
  • making an entry in the State Register of Rights;
  • issuance of a certificate of ownership (in cases provided by law).

In the end, to secure your land ownership right you need to perform two main actions of a technical and legal nature. The first is to enter information about the land plot into the cadastre; the second is to register your right to that plot.

Since ownership documents are technical in nature and include a large number of indicators, measurements, photographs, a certain part of them can only be prepared by specialists who have received accreditation.

And only after assigning a cadastral number is the registration of ownership rights to the land plot carried out, during which the plot is legally registered to the owner. For these two procedures, you must contact different state bodies.
