Apostille or consular legalization?

In fact, there are two legalization options — applying an apostille and consular legalization.

In the first option, legalization by applying an Apostille stamp to originals or copies concerns documents that will be used in the territories of the Hague Convention member states. At present, this includes the majority of European countries, parts of Latin America, and the list of countries is constantly expanding. Properly completed, an apostille certifies the authenticity of the signature and the status of the person who signed the document. A document with an apostille stamp from one Hague Convention country is unconditionally accepted in another country that has signed the Convention.

In the second option — consular legalization — the document is certified step by step by state authorities at different levels. Full consular legalization is applied in countries that have not signed the Hague Convention. Only after this procedure will official documents have legal force in the territory of the country whose consulate has affixed the mark. The main list of documents subject to legalization is extensive and each country sets its own requirements.

Specifics of translating legalized documents

Notarial translation of documents — notarization of the translator’s signature — is an integral part of all forms of legalization. It is required both in the simplified procedure — applying an apostille — and in the course of full consular legalization. Translation may be unnecessary in the case of legalizing commercial documents through the chamber of commerce, when the original is initially in a foreign language or duplicated in foreign and Ukrainian languages. Translation and legalization are relevant for both individuals and legal entities.

Within the simplified legalization (apostille), translation can be done before or after applying the apostille.

Stages of the comprehensive legalization procedure through applying an apostille

  1. Translation + Notarial certification of the translation + Apostille on the translation.
  2. Apostille on the original + Translation + Notarial certification of the translation.
  3. Apostille on the original + Notarial copy + Translation + Notarial certification of the translation + Apostille on the translation.

Full consular legalization is a rather complex process. The procedure consists of the following

  1. A notarial copy of the document is made (exceptions are completed notarial deeds drawn up by a notary).
  2. Translation into the official language of the country where the document is submitted.
  3. Notarial certification of the translation.
  4. Submission of the document to the Ministry of Justice of Ukraine for certification of the notary’s signature.
  5. Submission of the document to the MFA of Ukraine for certification of the Ministry of Justice employee’s signature.
  6. Submission to the Consulate of the destination country to confirm the signature of the MFA staff member.

During full consular legalization, translation is always required. Exceptions are countries that do not require it. For some countries, such as China or the UAE, a double translation is required — into the country’s language and into English. It all depends on the requirements of the receiving party, the authorized bodies, the employer, or the educational institution.
