Due to the development of intellectual property law in Ukraine, it has become necessary to protect your business from third-party encroachments.
Copyright refers to the author’s rights to works in the fields of literature, art and science. Most often such rights include: the author’s right to declare himself the creator of the work and, on that basis, to distribute, reproduce or make it available to the public, as well as the exclusive right to grant others the right to use the work in a manner determined by the author.

What does copyright protect?
As we noted earlier, the objects of copyright include works in the fields of literature, science, and art, namely:
- artistic and literary works (novels, dramatic and choreographic works, poems, translations, lectures, photographic works, audiovisual works, musical works, adaptations of works, etc.);
- data compilations (databases), if their arrangement or selection are the result of the author’s intellectual activity;
- computer programs;
- other works.
Copyright registration.
Registration of copyright is not a mandatory procedure. Since rights to a work arise from the moment of its actual creation, it is still recommended to contact specialists to carry out the appropriate registration actions properly.
Graphic designation of copyright.
To notify about one’s copyright, a special copyright protection sign or the copyright symbol is used. The copyright symbol is the Latin letter “C” enclosed in a circle ©; the name of the rights holder and the year of first publication are usually indicated next to the symbol.
It is important to understand that copyright can only protect the form of a work, not its essence. That is, copyright does not apply to principles, ideas, concepts, theories, methods, processes, procedures, discoveries, systems, techniques, even if they are described, expressed, illustrated and explained in the author’s work.
Copyright arises at the actual moment of creation of the work by the author and does not depend on the degree of its completion. In fact, copyright for music, photos, websites, paintings and other works arises at the moment of creation of these objects and is valid throughout the life of the author, and for 70 years after his death.
Advantages of copyright registration:
- obtaining a Certificate confirming authorship;
- ability to establish authorship for a licensee to conclude relevant agreements (license agreements, assignments, etc.)
- ensuring favorable resolution of disputes when engaging relevant authorities (courts, police, prosecutor’s office, etc.).
