Immigration is the entry of a foreign citizen or a stateless person into the territory of a country in the prescribed manner. Ukrainian legislation stipulates that a foreigner may immigrate to Ukraine for employment or permanent residence. The Laws of Ukraine «On Immigration» and «On the Legal Status of Foreigners and Stateless Persons» establish norms according to which, to obtain a permanent residence permit, foreigners must first obtain permission to immigrate to Ukraine. Such permission is issued within the immigration quota. Legislation distinguishes two groups of persons who apply for permission to immigrate.

Who can obtain permission to immigrate to Ukraine

The permission is issued within the immigration quota. The legislation identifies two groups of persons who can immigrate.

The first group includes non-residents under the immigration quota. They include specialists, cultural and scientific figures needed by the state, major investors who have contributed more than 100,000 USD. Also in this group are victims of human trafficking, refugees, persons granted asylum, former Ukrainian citizens and relatives of Ukrainian citizens (grandparents, grandchildren, brothers and sisters). Under the quota, parents, children, and the spouse of a person who has already obtained a permanent residence permit are processed.

The second group includes persons who may immigrate outside the quota:

  • spouse of a Ukrainian citizen (married for more than 2 years);
  • children or parents of a Ukrainian;
  • guardians or custodians of a citizen of the country, or persons who are under the guardianship/custodianship of a citizen;
  • persons who have the right to obtain Ukrainian citizenship by territorial origin;
  • those who represent a state interest for the country;
  • Ukrainians living abroad and their spouses.

If the foreigner is outside the country, to obtain permission to immigrate he should contact the Embassy or Consulate of Ukraine. If the foreigner has already entered the country, the documents are submitted to the authorized body at the place of residence.

List of documents required to obtain permission to immigrate

The full list of documents for obtaining permission to immigrate and the procedure for their consideration is provided by the Resolution of the Cabinet of Ministers of Ukraine No. 1983 of 26.12.2002. They include:

  • application for permission to immigrate;
  • passport document and its legalized translation;
  • a document evidencing the basis for obtaining the permission (for example, a birth or marriage certificate);
  • 3 photographs size 3.5 cm by 4.5 cm;
  • family information, documents proving family relationships, their legalized copies;
  • document proving the existence of a place of residence (in Ukraine and abroad);
  • document evidencing the absence of a criminal record;
  • a certificate issued by a medical-preventive institution confirming the absence in the applicant of the following diseases: drug addiction, chronic alcoholism, substance abuse, or infectious diseases specified by the central executive authority on health (if the person permanently resides outside Ukraine, a legalized document issued by a medical institution of the country of residence is submitted);
  • receipt of payment of the state fee or consular fee.
