In accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 150 dated 15.02.2012, foreigners or stateless persons may temporarily stay in Ukraine based on passport data registered in the manner prescribed by law.

Temporary registration in Kyiv is arranged by the non-resident within the period between the 10th and 3rd working days before the expiration of the foreigner’s lawful stay in Ukraine.

Grounds for extending the period of stay of foreign nationals

If citizens of other countries plan to stay in Ukraine for a longer period than allowed by their visa, or longer than the permitted period under the visa-free regime, they need to extend their registration at the local migration service office.

Documentary evidence of the purpose of stay must be provided — a certificate from a medical institution, an extract from the patient’s medical record, a notarized certificate of the opening of an inheritance case, copies of applications to the UMS, certificates from authorized state bodies of Ukraine confirming the occurrence of an accident (Ministry of Internal Affairs, fire inspectorate, seismological service).

List of documents required to extend the registration of non-residents

The foreigner, together with the host party, submits an application for extension of registration of a foreign national in Ukraine to the migration service at the place of residence. The foreigner is required to provide the following documents:

  • passport and its copy;
  • legalized translation of the passport;
  • document proving the availability of financial means;
  • document proving the availability of accommodation;
  • 4 copies of photographs sized 3.5 cm by 4.5 cm;
  • document confirming payment of the state fee.

If the host party is an individual, their passport and copy are submitted. If the host party is a legal entity, the passport of the head of the enterprise and its copy, an order appointing the person responsible for registering the foreigner, and an excerpt from the Unified State Register (EGR) are submitted.

The foreigner must also provide evidence of the necessity to extend the period of stay in Ukraine.

Violation of the period of stay in Ukraine

After the period of stay expires, the foreigner is considered illegal. If they do not leave Ukraine by that time or do not present documents confirming the grounds for extending temporary registration, administrative liability in the form of a fine is imposed.

Administrative liability is also imposed on Ukrainian citizens who assisted non-residents in staying in the country after the expiry of the period.

The Code of Ukraine on Administrative Offenses provides for the following amounts of fines:

  • violation by a foreigner of the deadlines or procedure for extending the period of temporary stay in Ukraine – from 100 to 300 non-taxable minimums of citizens’ income;
  • employment, education or provision of housing, as well as any assistance to foreign citizens and stateless persons in evading departure from Ukraine after the end of the period of stay in the country – from 100 to 200 non-taxable minimums of citizens’ income.

Processing times and cost of extending registration

After submitting documents to OVIR, the registration of foreign nationals lasts 3 working days. In practice, this period is extended up to 10 working days due to the need for additional checks. If the decision is made by the GMS, registration of the foreigner in OVIR takes 14 calendar days.

The legality of the stay is extended for the period necessary to resolve difficulties with departure – 30-180 days.

Rates for extending a foreigner’s stay in Ukraine are approved by Resolution of the Cabinet of Ministers of Ukraine No. 795 of 04.06.2007 and are regularly reviewed.

Sample application for extending the period of stay in Ukraine

According to the rules for registering foreign nationals, the non-resident must submit to OVIR an application for extension of temporary stay in the country. It is submitted between the 10th and 3rd working days before the expiration of lawful stay in Ukraine.

The Ministry of Internal Affairs has approved two forms of applications. The choice depends on whether the host party is an individual or a legal entity. Together with the application, the necessary documents are submitted to the territorial bodies or units of the State Migration Service (DMS).
